Terms and Conditions for Crown Your King: Mastering Your Drag King Persona

Welcome to Crown Your King: Mastering Your Drag King Persona! Please read these Terms and Conditions ("Terms") carefully before registering for our online group coaching program ("Program").

Acceptance of Terms

By registering for the Program, you agree to be bound by these Terms, which form a legally binding contract between you and sole trader, Danica Lani ("Company", "we", "us", or "our"). If you do not agree to these Terms, please do not register for the Program.

Program Description

Crown Your King is an online group coaching program designed to help you explore and master your Drag King persona. The Program includes live sessions, recorded content, community support, and other resources.

Intellectual Property Rights

All Program content, including videos, guides, worksheets, and other materials, is owned by the Company. You are granted a limited, non-exclusive, non-transferable license to use the Program content for your personal, non-commercial use only.

User Conduct

Participants are expected to conduct themselves with respect and integrity. Harassment, bullying, or other inappropriate behavior will not be tolerated and may result in removal from the Program without a refund.

Confidentiality Agreement

Participant Confidentiality: As a participant in the "Crown Your King: Mastering Your Drag King Persona" program, you may be privy to personal and sensitive information shared by other participants during the course of the program. You agree to maintain the confidentiality of all information shared within the program setting. This includes, but is not limited to, personal stories, experiences, performance techniques, and any other proprietary or sensitive information disclosed by participants or the Company.

Non-Disclosure: You agree not to disclose, disseminate, or use any such confidential information in any manner other than for the purposes of participating in the program and supporting your fellow participants. This confidentiality obligation will continue during and after the conclusion of the program.

Respect for Privacy: You acknowledge the importance of creating a safe and trusted environment for all participants to express themselves and share their experiences. You commit to respecting the privacy and personal boundaries of all individuals involved in the program.

Breach of Confidentiality You understand that any breach of this confidentiality agreement may result in immediate removal from the program without a refund and may expose you to legal action from the Company or other participants whose confidentiality rights have been violated.

Payment Terms

Payment is required upon registration. The Program fee is refundable within 14 days of registering for the program. Email [email protected] for a full refund. No questions asked.

Cancellation and Refund Policy

If you wish to cancel your registration, you must do so within 14 days of the Program start date to be eligible for a refund. Cancellations made after this period are not eligible for a refund.

Limitation of Liability

The Company's liability to you for any cause whatsoever, regardless of the form of the action, will be limited to the amount paid by you for the Program.

Physical Activity Disclaimer and Release

Acknowledgement of Risk: You acknowledge that participation in "Crown Your King: Mastering Your Drag King Persona" may involve physical activity, including but not limited to dancing, movement, and performance exercises. You understand that there is an inherent risk of injury associated with any physical activity and hereby affirm that you are voluntarily participating in these activities with knowledge of the risk involved. You agree to expressly assume and accept any and all risks of injury or death.

Health Declaration: You declare that you are physically fit and have no medical condition that would prevent your participation in the Program's physical activities. You are encouraged to seek medical advice if you have any concerns about your health or fitness levels prior to participating.

Liability Waiver: To the fullest extent permitted by law, you agree that the Company, its officers, employees, agents, and representatives shall not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort (including negligence), or otherwise, which arises out of or is in any way connected with your participation in the Program's physical activities.

Indemnification: You agree to indemnify and hold harmless the Company, its officers, employees, agents, and representatives from and against all losses, expenses, damages, and costs, including reasonable legal fees, resulting from any violation of these Terms or any activity related to your participation in the Program (including negligent or wrongful conduct).

Insurance You acknowledge that the Company holds public indemnity and public liability insurance. However, you understand that it is your responsibility to obtain personal insurance coverage for your participation in the Program if you deem it necessary.

Image and Likeness Release

Consent to Use of Image and Likeness: By participating in the Crown Your King: Mastering Your Drag King Persona program, you consent to the recording of your likeness and voice and grant the Company the right to use your image, likeness, voice, and other attributes of your personality ("Materials") as captured during your participation in the Program for any lawful purpose, including but not limited to advertising, promotion, and marketing of the Program or other products or services offered by the Company. You agree that the Materials may be used in print, online, and in video formats, and you understand that they may be edited or altered at the discretion of the Company.

Waiver and Release: You waive any right to inspect or approve the finished product or the advertising copy that may be used in connection with the Materials and release and discharge the Company from any claims, demands, or causes of action that you may have in connection with the use of the Materials, including without limitation any claims for defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright.

Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved in the first instance through friendly negotiation between the parties. If the dispute cannot be resolved by negotiation, the parties agree to submit the dispute to mediation, in accordance with the rules of the Australian Commercial Disputes Centre (ACDC). If the dispute is not resolved by mediation, the parties shall be free to pursue any right or remedy available to them under Australian law.

Changes to Terms

The Company reserves the right to modify these Terms at any time. Your continued participation in the Program following such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of NSW, Australia, without regard to its conflict of law provisions. The parties agree to submit to the exclusive jurisdiction of the courts located in NSW, Australia.
